The Affordable Broadband Act (ABA), established in New York General Business Law, obligates internet service providers (ISPs) in New York State, with some exceptions, to provide discounted plans to eligible households. According to the ABA, ISPs not exempt from the program must offer broadband service to qualifying households at a maximum of $15 per month for a minimum speed of 25 Mbps. If an ISP has a $20 monthly plan for high-speed broadband of at least 200 Mbps, they are compliant with the law. ISPs are not required to provide both options. They cannot impose bundles, extra fees, or taxes. Non-exempt ISPs must present reduced-cost plans for all connections exceeding fixed wireless, wireline, or satellite services, but mobile or dial-up services are excluded. Households in New York can qualify for these broadband plans if they participate in any of the following programs: Free or reduced-priced lunch through the National School Lunch Program, Supplemental Nutrition Assistance Program, Medicaid, Senior citizen rent increase exemption, Disability rent increase exemption, or an affordability benefit from a utility.
