- According to the McKinney-Vento Homeless Act, families or students are considered homeless and qualify for special rights if they are in shelters, motels, vehicles, campgrounds, on the street, in 24-hour restaurants, or bus stations, displaced by disasters, living in inadequate conditions, or 'couch surfing' with friends or relatives due to a lack of affordable housing.
