About this resource
Estate Recovery and Property Liens involve the potential imposition of a lien on an individual's estate for the value of Medicaid benefits received after reaching the age of 55. If the individual does not have an estate, claims can be made against the estate of their spouse. Recovery efforts will not commence until after the death of the individual and their surviving spouse. These programs are managed by the Bureau of Financial Operations within the Division of Medicaid. Language assistance is available in English and Spanish.
